Why You Should Consider Revising Your Estate Planning Document

As estate planning attorneys, we discuss with clients the importance of having estate planning documents in place and updating those documents as circumstances change. You should review documents about real estate planning every five years to determine if revisions are necessary. You may require changes if things have changed since you last checked the documents. Here are some instances of how changes in your life might require you to update your documents:

  • Marriage. You must update any estate planning documents before the wedding to include provisions for the new spouse. These changes could involve naming your spouse as the primary executor in your updated power of attorney documents, naming your spouse as the executor in your will, or simply ensuring that your spouse is cared for and receives assets under your will.
  • Children. Changes to children’s estate planning documents are applicable in various situations. When children are born, estate planning documents should be updated, with particular attention paid to minor children planning. This may include naming guardians for small children and amending a testamentary trust. Furthermore, when children reach a certain age or become legal adults, estate planning may need to be updated.
  • Moving. Although moving out of state or out of the country is a significant life change that should be discussed with your estate planning attorney, updating your plans is not always required when a move occurs. You should edit your estate planning documents if you are relocating out of the state or out of the country. This ensures that they are recognized and recognized in your new location. Also, you should change your will to reflect any gifts of property that have been sold or given to someone else.
  • A job or career change. When a person changes jobs or careers, estate planning documents may not need to be updated as frequently. However, you should review beneficiary designations for retirement accounts and life insurance policies. If the intention is to have them in line with your will’s provisions, these beneficiary designations should be reviewed and updated regularly but significantly when changing jobs or employers.
  • Divorce. Planning documents for a couple, which may have previously mostly contained spousal provisions, should be updated following divorce. A Healthcare Proxy document and a Financial Power of Attorney list a former spouse as the primary agent and may need to be updated.
  • A family member’s death or illness. When a family member dies, and that person was named in estate planning documents, whether as an heir, executor in a will, or agent under a power of attorney document, those documents should be reviewed to ensure that you adequately planned for a successor or contingency plan.
